Terms of Service

These Terms of Service (“Terms”) govern your use of the Phad platform, including the Chrome extension, the website at phad.ad, and all related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. What Phad is
Phad is a paid-attention platform. Brands fund monetary pools tied to specific content across YouTube, TikTok, Instagram, Facebook, Vimeo, images, and brand websites. Users (“Earners”) earn real money by verifiably engaging with that content. Campaigns may include Capture the Phad (CTP), recall quizzes, jackpot draws, and brand site visit bonuses. Phad is not a gambling, sweepstakes, or lottery service—jackpots are funded entirely by the brand's pool and guaranteed to be awarded when the pool depletes.
2. Eligibility
- You must be at least 18 years old to use Phad
- You must provide a valid email address to create an account
- You must be located in a jurisdiction where receiving payments for viewing content is legal
- One account per person. Duplicate accounts will be terminated
3. Earner accounts
As an Earner, you can browse available campaigns (“Phads”), engage with content across supported platforms, capture Phads, complete optional quizzes, and accumulate earnings in your Phad wallet. Earnings are denominated in US dollars and include base payouts, click bonuses, visit bonuses, conversion bonuses, and jackpot winnings. You can withdraw your balance at any time once it meets the minimum withdrawal threshold ($1.00) via Stripe Connect.
4. Brand accounts
Brands can create campaigns by funding a pool, selecting target content (video, image, or brand site URL), configuring engagement modes (CTP, quiz, watch-only), setting jackpot percentages, and optionally enabling click, visit, and conversion bonuses with brand site tracking. Pool funds are non-refundable once the campaign goes live and completions have been recorded. Brands may pause or close campaigns at any time, but already-earned payouts will still be honored.
5. Creator accounts
Content creators can claim campaigns running on their content across any supported platform. When a creator claims a campaign, they receive 20% of every completion payout, the platform fee drops to 10%, and the earner receives 70%. Creator earnings are tracked separately and can be withdrawn via Stripe Connect.
6. Attention verification
Phad verifies attention using engagement tracking (watch time for videos, viewport visibility for images, dwell time for brand sites), tab focus detection, playback speed monitoring, seek detection, and CTP Phad capture validation. You must engage with the content at normal speed, in an active browser tab, without skipping, to qualify for a payout. For CTP-enabled campaigns, you must capture the required percentage of Phads. Phad reserves the right to withhold payouts if verification checks are not met.
7. Jackpots
Campaigns may include a jackpot funded from the campaign pool. The jackpot amount is reserved when the pool is created. When the base pool is exhausted, one random winner is drawn from all qualified completers (earners who met CTP and/or quiz thresholds). The jackpot is guaranteed to be awarded—it is not contingent on chance of selection, but on pool depletion. The jackpot is not split with creators or the platform; 100% goes to the winner.
8. Prohibited conduct
You agree not to:
- Use bots, scripts, automation, or any method to fake engagement verification
- Create multiple accounts to earn from the same campaign more than once
- Manipulate playback speed, use tab-spoofing extensions, or circumvent any anti-gaming protections
- Share or pre-compute CTP Phad timestamps or positions to help others bypass Phad capture requirements
- Fake click-throughs, visit durations, or conversion events to earn bonuses fraudulently
- Attempt to reverse-engineer, decompile, or tamper with the Phad extension or backend
- Use the Service for any illegal purpose or in violation of any applicable law
Violation of these rules may result in immediate account termination and forfeiture of any unpaid balance.
9. Payments and withdrawals
- Earner payouts are processed through Stripe Connect. You must complete Stripe’s onboarding to withdraw funds
- Minimum withdrawal amount is $1.00
- Phad retains a platform fee from each completion: 20% for unclaimed campaigns, 10% for creator-claimed campaigns. The remainder is split between the Earner and, if applicable, the content Creator (20%)
- Bonus payouts (click, visit, conversion) are additional and deducted from the campaign pool separately from base payouts
- Brand payments for pool funding are processed through Stripe and are non-refundable once the campaign is live with recorded completions
- Phad is not responsible for delays or failures caused by Stripe or your financial institution
10. Intellectual property
The Phad name, logo, extension, website, and all associated code and design are the property of Phad. You may not copy, modify, or distribute any part of the Service without written permission. Content viewed through Phad campaigns remains the property of its respective creators and platforms.
11. Account termination
You can delete your account at any time from the Settings page on your dashboard. Phad may suspend or terminate your account if you violate these Terms. Upon termination, any unpaid balance below the minimum withdrawal threshold is forfeited. If your balance meets the withdrawal threshold, you will have 30 days to withdraw before funds are forfeited.
12. Disclaimers
- The Service is provided “as is” without warranties of any kind, express or implied
- Phad does not guarantee the availability of campaigns, payout amounts, or uninterrupted service
- Campaign pools may be exhausted at any time. Completing content does not guarantee a payout if the pool runs out before your completion is recorded
13. Limitation of liability
To the maximum extent permitted by law, Phad’s total liability to you for any claims arising from your use of the Service is limited to the amount you have earned and successfully withdrawn in the 12 months preceding the claim. Phad is not liable for indirect, incidental, or consequential damages.
14. Changes to these Terms
We may update these Terms from time to time. Changes will be posted at phad.ad/terms with an updated date. Continued use of the Service after changes are posted constitutes acceptance of the new Terms.
15. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
